Abstract

In the midst of the controversy among the scholars about the status of the qiraat shadhdhah as hujjah, Abu Ja'far al-Tusi wrote an exegesis entitled al-Tibyan fi Tafsir al-Qur'an which contains qiraat shadhdhah. This research is interesting to do because when interpreting certain verses, al-Tusi completely includes all variations of qiraat both with mutawatir and shaddhah status, then makes them a consideration in legal istinbat. Based on the background above, the formulation of the problems in this study are: 1) How is the use of qiraat shadhdhah in the book al-Tibyan fi Tafsir al-Qur'an? 2) What are the implications of qiraat shadhdhah on legal istinbat for munakahat verses in QS. al-Nisa'/04 in the book al-Tibyan fi Tafsir al-Qur'an?. To further facilitate the analysis process, the research will be investigated using two theories; the theory of qiraat and theory of legal istinbat of Ja'fari. This study results two conclusions. One, among other Shi'ah scholars, al-Tusi is a scholar who is quite objective in choosing qiraat al-Qur'an. Unfortunately, in al-Tibyan fi Tafsir al-Qur'an, he did not massively include discussion of qiraat, including qiraat shadhdhah. Variations of qiraat were more widely used to strengthen his argument which tends to use a linguistic approach. Two, there are four verses in the verses of munakahat QS. al-Nisa'/04 which contains qiraat shadhdhah. They are at QS. al-Nisa'/04, 04, 19, 34, and 24. Qiraat shadhdhah in the first three verses has no implications for legal istinbat, while the last verse has implications for the permissibility of temporary marriage. Upon further analysis, the arguments for al-Tusi's interpretation regarding mut'ah are considered to comply with the correct Shi'ah legal istinbat methods, namely using the legal sources of the Koran, sunnah, ijma', and reasoning. Therefore, his decision regarding the permissibility of temporary marriage methodologically deserves to be made a legal product and can be practiced.
