Abstract

Skripsi ini merupakan hasil penelitian empiris yang berjudul ”Tipologi Korban Dalam Tindak Pidana Pelecehan Seksual Dalam Perspektif Viktimologi dan Hukum Pidana Islam”. Skripsi ini ditulis guna menjawab pertanyaan yang dituangkan dalam dua rumusan masalah, yaitu bagaimanakah peran korban dalam tindak pidana begal payudara dalam perspektif viktimologi dan bagaimanakah peran korban dalam tindak pidana begal payudara dalam perspektif hukum pidana Islam. Jenis penelitian yang dilakukan yaitu penelitian hukum yang bersifat empiris dengan menggunakan pendekatan yuridis empiris atau yuridis sosiologis. Sumber data yang diperoleh dalam penelitian ini yaitu sumber data primer dan sumber data sekunder. Sumber data sekunder diperoleh dari beberapa jurnal, penelitian, atau artikel yang berhubungan dengan tema penelitian. Sedangkan sumber data primer diperoleh dari hasil wawancara yang dilakukan di Polres Mojokerto tepatnya dalam Unit PPA. Selain itu teknik analisis data yang digunakan peneliti dalam penelitian ini yaitu menggunakan deskriptif analisis. Kesimpulan dalam penelitian ini yaitu dari ketiga kasus yang diteliti di Polres Mojokerto, dua diantaranya terdapat adanya peranan korban dalam menimbulkan terjadinya suatu tindak pidana begal payudara. Sedangkan dalam hukum pidana Islam, tidak terdapat aturan khusus yang membahas tentang tipologi korban baik itu dalam Al-Qur’an maupun Hadist. Namun, Allah memerintahkan pada semua umat-Nya untuk menjaga pandangan, menjaga kemaluan, menutup aurat, dan melarang perempuan untuk keluar rumah agar terhindar dari kejahatan. Adapun saran untuk semua orang terutama perempuan, orang tua, anak- anak atau seorang yang dengan kondisi fisik atau mental lemah yaitu agar lebih berhati-hati lagi dalam segala hal terutama dalam berpakaian dan bepergian keluar rumah. Selain itu, diperlukannya juga kepedulian masyarakat sekitar terhadap kejahatan yang terjadi. Serta pentingnya menjaga pandangan dan mengendalikan hawa nafsu yang dimiliki oleh setiap orang. This thesis is the result of empirical research entitled "Typology of Victims in Crimes of Sexual Harassment from the Perspective of Victimology and Islamic Criminal Law". This thesis was written to answer questions outlined in two problem formulations, namely what is the role of the victim in the crime of breast robbery from a victimology perspective and what is the role of the victim in the crime of breast robbery from the perspective of Islamic criminal law. The type of research carried out is empirical legal research using an empirical juridical or sociological juridical approach. The data sources obtained in this research are primary data sources and secondary data sources. Secondary data sources were obtained from several journals, research, or articles related to the research theme. Meanwhile, the primary data source was obtained from interviews conducted at the Mojokerto Police, specifically in the PPA Unit. Apart from that, the data analysis technique used by researchers in this research is descriptive analysis. The conclusion in this research is that of the three cases studied at the Mojokerto Police, two of them contained the role of the victim in causing the crime of breast robbery. Meanwhile, in Islamic criminal law, there are no special regulations that discuss victim typology, whether in the Qur'an or Hadith. However, Allah commands all His people to watch their eyes, protect their private parts, cover their private parts, and forbid women from leaving the house to avoid evil. The advice for everyone, especially women, the elderly, children or people with weak physical or mental conditions, is to be more careful in everything, especially when dressing and traveling outside the house. Apart from that, the local community also needs to be aware of the crimes that occur. As well as the importance of maintaining one's views and controlling the desires that each person has.
