Abstract
This research discusses handover issues in transfers and credits. It is a field study at the Central Bank of Libya. The problem formulation is as follows: How to arrange and apply transfers and credits at the Central Bank of Libya, and are the handovers following applicable standards and laws? How does the Central Bank of Libya apply Sharia rules and standards regarding handovers in transfers and credits? What are the positive and negative effects on citizens and the national economy of providing transfers and credit at the Central Bank of Libya? The researcher used a qualitative approach. The tools for collecting the data were interviews, observations, and documents. The Central Bank of Libya was the source of data collection. The researcher interviewed several officials in the Central Bank of Libya in departments related to the research theme, observations, and documents obtained from the bank. The researcher concludes the implementation and arrangement of handovers in transfers and credits at the Central Bank of Libya are based on the criteria set by the bank. Banking operations related to handovers follow specific steps and conditions by safeguarding the rights of all parties, while transfers take precedence over currency sales. Transfers and credits are arranged according to the bank code (BSL) and carried out in the swift system. When enhanced credit is applied, the result demonstrates conformity and comprehensive compatibility of the Central Bank of Libya standards with approved Sharia and accounting standards (AAOIFI), except in some limited cases for applications such as commissions. The provision of bank transfers and credits has both positive and negative effects on citizens and the national economy. The main positive effect is the cessation of interest in usury transactions related to transfers and credits. In addition, these credits and transfers alleviate most of the liquidity problems and help citizens to provide the necessary consumer goods. The most notable negative effects are deviations resulting from the application of transfers and credits due to differences in currency prices of some of the beneficiaries, as well as political conditions, the resulting division of the Central Bank of Libya institution, and the complexity of procedures for citizens as a result of these circumstances. This research recommends paying more attention to sharia supervision in preventing sharia violations in transfers and credits and paying attention to employees to meet sharia and functional skills requirements. The implications of this research theory are: The handover at the Central Bank of Libya is compatible with the provisions of Islamic Sharia. It can be seen from the controls established by banks regarding transfers and credits or the precise controls established by AAOIFI. However, there are some possible violations from citizens, companies, or external parties related to the central bank.
